Terms of Service
By using Evolera you agree to these terms. They come down to one thing: we provide phone and AI tools, and you are responsible for what you do with them.
1. The service
We provision a work phone number for you and provide calling, messaging, and an AI assistant that can answer, transcribe and summarize. The service depends on third-party telecom and AI providers (see our Privacy Policy). We do not guarantee uninterrupted or error-free operation.
2. Your responsibilities
- Comply with applicable law, including Canada’s Anti-Spam Legislation (CASL), CRTC rules, and call-recording notice requirements.
- Ensure you have the right to use the business material you upload and the client information you enter.
- You are responsible for content the assistant generates. Advice requiring a licence — insurance, legal, medical, financial — must come from you, not from the assistant’s wording.
- Do not use the service for unsolicited marketing calls or bulk messaging.
3. Prohibited use
The following will result in immediate suspension or termination without refund:
- Harassment, fraud, or impersonating a person or organization.
- Bulk cold calling, unsolicited telemarketing, or automated mass messaging.
- Circumventing our usage limits, blocking mechanisms, or safety controls.
- Reselling the service, or placing calls on behalf of others at scale.
We may suspend outbound calling and messaging while we investigate a reasonable suspicion of the above.
4. Phone numbers
- We provision the work number on your behalf. It is available to you for the duration of your subscription; ownership does not transfer.
- When your account or subscription ends, the number is released. A released number cannot be recovered.
- The service does not support number porting, in or out.
5. Fees
The service is in early testing and pricing is not final. The terms provided to you in writing at sign-up govern. Usage beyond any included allowance is billed at actual cost.
6. Emergency services
Evolera is not a telephone company and does not provide 911 or other emergency calling. In an emergency, use your mobile or landline to dial 911 directly.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss, including lost business, lost clients or lost data. Our total liability will not exceed the fees you actually paid in the twelve months before the event giving rise to the claim.
8. Termination
You may close your account at any time. We may terminate the service if you breach these terms. After termination we handle your data as described in the Privacy Policy.
9. Governing law
These terms are governed by the laws of the Province of Ontario, Canada.
